Terms of Service Agreement

Career Coaching & Consultations

EFFECTIVE DATE: This Terms of Service Agreement was last updated on February 7, 2024.

Please read this Agreement carefully.

 

NOTE: The term “Client” refers to the Client receiving services (including no-fee consultations). The terms “we” and “us” and “Omega Forty Seven” refer to Omega Forty Seven Consulting. Omega Forty Seven operates under Maryland state law.

DESCRIPTION OF COACHING SERVICES: Omega Forty Seven is providing individual career coaching services. The purpose of career coaching is to guide the Client towards achieving a career goal or to provide guidance for a career-related issue. Coaching provided by Omega Forty Seven is not to be used in lieu of professional advice for psychological, psychiatric, legal, financial, medical, tax, or other matters generally handled by other certified professionals. No verbal or written promise or guarantee of any job or employment, promotion, job interview, or career/educational advancement is made or implied under the terms of the contract. 

 

MEETING FORMAT: Unless otherwise communicated, all sessions will be held via video conferencing. In the event of unforeseen technical difficulties, an audio or phone conference may replace a video session. The Client will need access to a functioning camera with audio. 

PAYMENT: Payment is accepted upfront via online payment. Payment is due in full before services can be rendered. We do not accept payment installments.

 

GENERAL REFUND POLICY: Because our services are rendered in an in-person and/or digital format and cannot be physically returned, our fees are non-refundable. Services must be redeemed within one (1) calendar year of the purchase date or will be considered forfeited and no refund will be issued. 

 

APPOINTMENTS: All coaching sessions are subject to availability. We cannot guarantee desired dates or time slots will be available.

CANCELLATIONS: Cancellations must be made at least twenty-four (24) hours in advance or client will be subject to a $45 cancellation fee. Being more than fifteen (15) minutes late to a session will be considered a cancellation. In the event of unforeseen circumstances, Omega Forty Seven may be required to cancel sessions. We will notify the client as early as feasibly possible of the cancellation and will coordinate rescheduling.

COMMUNICATION: Unless otherwise communicated, all communication will occur via email, phone, or video conference. Omega Forty Seven will make two (2) attempts to contact Client; however in the event the Client does not respond, it will be considered a forfeit of services. While we strive to respond to messages within two (2) business days, we cannot guarantee that all correspondence will be replied to within this timeframe. This includes responses to emails submitted under the email support service package. In order to ensure a pleasant, professional-caliber environment while utilizing our services, we strictly prohibit use of hateful, profane, or vulgar language within any communication and/or documentation. This includes, but is not limited to in-person conversations, video conferences, messaging, text within documents, live chat, and phone consultations. Violations of this policy are subject to immediate discontinuation of service without refund. By entering their contact information, including but not limited to their phone number and email address, Client consents to follow-up calls, text messages, and emails from our team.

CONSULTATIONS: Initial consultations are subject to availability. Unless otherwise communicated, consultations will be held via video conferencing for a period of up to, but no more than, fifteen (15) minutes. Consultations are a forum where Clients and potential Clients can ask general service-related questions. It is not intended to be nor is structured as a Strategy Session in which specific (rather than general) career guidance is provided. By entering their contact information in the Free Consultation booking form, including but not limited to their phone number and email address, Client consents to follow-up calls, text messages, and emails from our team. Only one Free Consultation per Client.

 

JOB SEARCH AND CAREER ADVANCEMENT RESPONSIBILITY: The Client agrees that though Omega Forty Seven strives to provide high-quality professional advice, tools, and ideas, we cannot be responsible for changing market conditions; job posting changes; Client qualifications, skillsets, willingness to implement their action plan; or other factors that may affect a job search or career advancement. Ultimately Client success in the job market is solely their responsibility. We make no expression of implied guarantees of employment or advancement. No verbal or written promise or guarantee of any job or employment, promotion, job interview, or career/educational advancement is made or implied under the terms of this contract. Client commitment directly impacts the effectiveness of the coaching process. Clients agree to dedicate a minimum of five (5) hours per week to their job search or career advancement outside of scheduled sessions to optimize coaching results. 

PRIVACY POLICY: Omega Forty Seven may collect personal Client information (name, email address, phone number, work history, etc.) solely for the purpose of guiding sessions. We securely store this information electronically but cannot guarantee Client information will not been seen or accessed by a third party. Omega Forty Seven will comply if required by law to disclose information discussed in any Client session. We do not guarantee Client privacy over third party video conferencing systems such as, but not limited to Zoom, Microsoft Teams, Google Hangouts, or WebEx, phone, or email.

LIMITATION OF LIABILITIES: In no event will Omega Forty Seven be liable to the Client or to any third party for incidental, indirect, exemplary, special or consequential damages, whether foreseeable or unforeseeable, arising out of or otherwise relating to the services or the use or performance of the service, even if Omega Forty Seven has been advised of the possibility or likelihood of such damages. Without limiting the foregoing, in no event will the liability of Omega Forty Seven to the Client for any claim whatsoever related to the service or the services or any order or this agreement, including without limitation, any cause of action sounding in contract, tort or strict liability, exceed the purchase fees received by Omega Forty Seven.

 

INDEMNIFICATION: The Client agrees to indemnify and hold Omega Forty Seven, its parents, subsidiaries, affiliates, officers and employees, harmless from any claim or demand, including reasonable attorneys’ fees and costs, loss of income, earnings, compensatory claims, punitive damages, loss of consortium, loss of a position, any and all damages resulting from a denial of a position, or denial of an interview for a position, or denial of a position, or a cancelation or revocation of any job or internship offer made by any third party due to or arising, the violation of this Agreement, or infringement by the Client, of any intellectual property or any other right of any person or entity.

PACKAGES: Service packages have been carefully crafted and cannot be customized, modified, or changed, unless otherwise noted. All service packages are subject to the Terms of Services listed above.

Written & Electronic

Documents

DESCRIPTION OF DRAFTING, WRITING, EDITING, REVAMPING, AND ELECTRONIC DOCUMENT SERVICES: Omega Forty Seven is providing drafting, editing, and revision services including, but not limited to resume & LinkedIn reviews and/or revisions, and personalized scripts, and roadmaps. The intake and evaluation of the Client's current resume and job targets may be determined either via an electronic questionnaire or via a video conference session. We are not responsible for providing service(s) in the event the Client fails to email us their initial resume and/or LinkedIn profile, does not provide required information during a video conference session, does not provide a completed questionnaire form, or fails to provide correct contact information.

 

GENERAL REFUND POLICY: Because our services are customized and rendered in a digital format, our fees are non-refundable.

 

PROOFREADING: The Client is responsible for thoroughly reviewing all written and/or electronic documents provided as a result of service for accuracy and completeness. If corrections are needed, the Client is asked to email us correction requests. Omega Forty Seven is not responsible for omissions made on behalf of the Client or incorrect information. We are not liable for false statements provided by the Client.


REVISIONS: With the exception of correcting inaccuracies, subsequent revisions will be available to the Client at a $25.00 minimum fee per draft. The final fee will be assessed based on the scope of work required.  


ELECTRONIC FILES: Omega Forty Seven does not guarantee compatibility of computer files with Client operating systems or that documents will retain their original formatting features. Please note that Omega Forty Seven does not provide technical support on document formatting.

PROJECT TIMELINE: Project timeline will be discussed in advance between Omega Forty Seven and the Client and is contingent upon scope of work, date of intake or receipt of completed questionnaire, and other factors. While we strive to provide Clients with written or digital documents within a reasonable timeframe, we cannot guarantee a specific time for completion due to unforeseen circumstances or other reasons. We only provide estimated timeframes. If the Client does not respond to any questionnaire form, does not complete it in its entirety within a calendar year, or fails to provide required information during a video conference, Omega Forty Seven will be considered void of any further editing obligations.
